Ohio Guardianships

When an older family member has failed to create an estate plan with medical and financial powers of attorney, a guardianship may be necessary. A guardianship is a process through which the probate court declares a person to be legally incompetent and appoints someone else to make decisions about their medical or financial well-being. The incompetent person is referred to as the ward.

There are two types of guardianship: guardianship of the person and guardianship of the estate. A guardianship of the person allows another person to make medical decisions or living arrangements for a ward. A guardianship of the estate appoints another person to manage the financial affairs of the ward.
